ASIC finalises digital asset guidance after consultation
ASIC completed its consultation process on the regulation of digital assets by finalising its updated guidance, Information Sheet 225 (INFO 225).
Following the release of a draft and feedback from industry, ASIC clarified that many digital assets including stablecoins, wrapped tokens, and tokenised securities are considered financial products under existing Australian law. Consequently, businesses dealing with these products generally require an AFSL.
To provide time to comply with the clarified requirements, ASIC granted a sector-wide no-action position until 30 June 2026. Read more here.

ASIC seeking feedback on derivative clearing rules
ASIC is seeking feedback on a proposal to remake the ASIC Derivative Transaction Rules (Clearing) 2015, which are scheduled to expire on 1 April 2026. The remake is largely the same but includes a key update to extend exemptive relief for derivative transactions resulting from post-trade risk reduction exercises.
The rules apply to certain Australian and foreign financial entities (clearing entities) that deal in OTC interest rate derivative products. Read more here.

ASIC launches new breach data dashboard
ASIC has launched a new public dashboard, called the Reportable Situations dashboard, to provide transparent data on reported breaches of the law by AFSL’s and credit licensees.
The dashboard aims to promote improved compliance and reporting practices across the financial and credit sectors and includes granular information on:
- The volume and nature of breaches.
- The customer impact and loss caused by the breaches.
- The status of the investigation and rectification of the breaches.
- The level of customer compensation and remediation.
This launch fulfils ASIC’s requirement to annually publish information about reports lodged under the Reportable Situations regime. Read more here.
OAIC launches interactive data breach dashboard
The Office of the Australian Information Commissioner (OAIC) launched a new, interactive Notifiable Data Breaches (NDB) dashboard.
This tool provides a dynamic view of reported data breaches to help reporting entities (organisations and agencies) learn from and improve their security responses. Key data for January–June 2025 showed 532 notifications, with malicious attacks as the leading cause (59%). Read more here.
